Welcome to Roy David. The terms “we”, “us”, and “our” refer to Roy David. Roy David operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”), in order to provide you with a curated shopping experience.

Our store is hosted on Shopify Inc. (“Shopify”), which provides the e-commerce platform enabling us to offer the Services.

SECTION 2 — PRODUCTS & ARTWORK CHARACTERISTICS

All products offered are either original artworks (one of one) or limited edition prints.

We make reasonable efforts to display products accurately. However, due to differences in devices, browsers, lighting conditions, and screen calibration, colors, textures, scale, and appearance may vary from what is displayed online.

Such variations do not constitute defects, non-conformity, or grounds for return, refund, or cancellation.

All product descriptions, availability, pricing, and specifications are subject to change without notice at our sole discretion.

SECTION 3 — ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase. We reserve the right to accept, reject, or cancel any order at our discretion, including in cases of pricing errors, availability issues, suspected fraud, or technical mistakes.

An order is not accepted until payment has been successfully processed and a confirmation email has been issued.

All purchases are subject to our Return & Refund Policy, which forms an integral part of these Terms.

You represent and warrant that purchases are made for personal use only and not for resale or commercial distribution.

SECTION 4 — PRICING, PAYMENTS & TAXES

Prices are shown in the currency selected at checkout and may change without notice.

Unless expressly stated otherwise, prices do not include shipping, customs duties, import taxes, VAT, sales tax, or other governmental charges, which are the responsibility of the buyer.

By submitting payment information, you represent and warrant that you are authorized to use the selected payment method and that all charges incurred will be honored.

SECTION 5 — SHIPPING, DELIVERY & RISK

Delivery times are estimates only and are not guaranteed.

Once an order is handed to the shipping carrier, risk of loss and responsibility for the shipment pass to you, except where mandatory consumer protection laws provide otherwise.

We are not responsible for delays, losses, or damages caused by carriers, customs authorities, force majeure events, or circumstances beyond our control.

SECTION 6 — RETURNS & REFUNDS (LEGAL COMPLIANCE)

All sales are final, as detailed in our Return & Refund Policy.

Nothing in these Terms limits or excludes mandatory consumer rights that cannot be waived under applicable law.

EU customers:

Where applicable under EU consumer law, statutory rights relating to defective or non-conforming goods remain unaffected. The right of withdrawal does not apply to original artworks or limited edition prints produced in limited quantities, where legally permitted.

US customers:

Purchases are governed by applicable federal and state laws. Final-sale policies are enforceable to the fullest extent permitted by law.

SECTION 7 — INTELLECTUAL PROPERTY

All content on the Services, including artworks, images, text, graphics, logos, and designs, is the exclusive property of Roy David or its licensors and is protected by international intellectual property laws.

The Services are provided for personal, non-commercial use only. No content may be reproduced, distributed, modified, or used for commercial purposes without prior written consent.

All rights not expressly granted are reserved.

SECTION 8 — OPTIONAL & THIRD-PARTY TOOLS

The Services may include access to third-party tools, integrations, or links provided “as is” and “as available.”

We do not control, endorse, or assume responsibility for third-party services and shall not be liable for any damages arising from their use.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

The Services are powered by Shopify; however, all sales and transactions are made directly with Roy David.

You acknowledge and agree that Shopify bears no responsibility for transactions, disputes, or claims arising from purchases made through this website and expressly release Shopify from any related liability.

SECTION 10 — PRIVACY & DATA PROTECTION

Your use of the Services is subject to our Privacy Policy.

For EU consumers, this does not deprive you of protections afforded by mandatory consumer laws of your country of residence.
